Terms and Conditions of the gamb.com.pl Online Store

§ 1. General provisions and contact details

  1. These terms and conditions (hereinafter: the "Terms and Conditions") set out the rules for using the online store available at gamb.com.pl (hereinafter: the "Store"), the rules for placing orders for the offered products (including PPF films, tools, and accessories), as well as the rights and obligations of the Clients and the Seller.
  2. The owner of the Store and the Seller is:

    (hereinafter: the "Seller").

    • in writing to the company's registered address.

§ 2. Definitions

  1. Client – a natural person (Consumer), a legal entity, or an organizational unit without legal personality that makes purchases in the Store (both B2B and B2C).
  2. Consumer – a natural person making a legal transaction with an entrepreneur not directly related to their business or professional activity.
  3. Entrepreneur with consumer rights – a natural person concluding a contract directly related to their business activity, when the content of this contract shows that it does not have a professional character for them.
  4. Goods / Product – movable items available in the Store (e.g., rolls of PPF film, detailing accessories), as well as goods with properties specified by the Client (e.g., pre-cut PPF templates).

§ 3. Technical requirements and creating an Account

  1. To use the Store, it is necessary to have a device with Internet access, an updated web browser with cookies enabled, and an active e-mail account.
  2. The Client can place orders as a "Guest" (without registration) or by creating a free Client Account.
  3. Creating an Account is voluntary and makes it easier to track the order status and view purchase history. The Client is obliged to provide true data during registration and to protect their password.

§ 4. Placing and fulfilling orders

  1. Orders in the Store can be placed 24 hours a day, 7 days a week.
  2. To place an order, the Client selects the Goods, adds them to the virtual shopping cart, chooses the delivery and payment method, and then confirms the order with the "Order with obligation to pay" button (or equivalent).
  3. Placing an order constitutes an offer to conclude a sales agreement. After the order is paid, the Seller sends a confirmation of its acceptance to the provided e-mail address – at this point, a legally binding sales agreement is concluded.
  4. Prices in the Store are given in Polish zlotys (PLN) and include VAT (gross prices).

§ 5. Payments and delivery

  1. The Seller provides the following payment methods for the order:
    • Electronic payments (fast online bank transfers, BLIK, payment cards) processed via the secure PayU system,
    • Bank transfer (traditional) processed directly to the Seller's bank account (the order is forwarded for processing after the payment is credited),
    • Cash on delivery (payment in cash or by card to the courier upon delivery of the parcel).
  2. Delivery is carried out within the territory of the Republic of Poland.
  3. Delivery costs are covered by the Client, unless the Store's offer at a given moment states otherwise (e.g., a promotion for free delivery over a certain order amount applies).
  4. The shipping time for the Goods is usually from 1 to 3 business days. In the case of choosing payment by bank transfer or PayU, this time is counted from the moment the full payment is credited. In the case of templates cut to individual order, the shipping preparation time may be slightly extended, of which the Client is informed.

§ 6. Right of withdrawal (Returns)

  1. A Client who is a Consumer or an Entrepreneur with consumer rights has the right to withdraw from the contract without giving any reason within 14 days from the date of taking possession of the Goods.
  2. To exercise the right of withdrawal, an unambiguous statement must be sent (e.g., by e-mail to gambppf@gmail.com or by mail to the company's address). The Goods must be returned immediately, no later than 14 days from the date of informing about the withdrawal. The cost of returning the goods is borne by the Client.
  3. IMPORTANT EXCEPTION: The right to withdraw from a distance contract does not apply to the Client in relation to contracts in which the subject of the service is a non-prefabricated item, manufactured to the Consumer's specifications or serving to satisfy their individualized needs. This applies in particular to: PPF films cut from a roll to the size specified by the Client and ready-made templates cut with a plotter for a specific vehicle model ordered by the Client (in accordance with Article 38 point 3 of the Polish Consumer Rights Act).

§ 7. Complaints (Lack of conformity of the goods with the contract)

For Consumers and Entrepreneurs with consumer rights:

  1. The Seller is obliged to deliver Goods in conformity with the contract. We are liable for any lack of conformity of the Goods with the contract existing at the time of delivery and revealed within 2 years from that moment.
  2. In the event of a defect, the Client may request repair or replacement. If this is impossible or requires excessive costs, the Client may request a price reduction or withdraw from the contract.
  3. Complaints should be submitted by e-mail to: gambppf@gmail.com. The Store will respond to the complaint within 14 days.

For Entrepreneurs (B2B Clients):

  1. Pursuant to Article 558 § 1 of the Polish Civil Code, the Seller's liability under the statutory warranty for physical and legal defects of the Goods towards Clients who are Entrepreneurs (who are neither Consumers nor Entrepreneurs with consumer rights) is completely excluded.
  2. Any potential claims resulting from the properties of the film should be directed under the manufacturer's warranty (if granted). Any potential liability for damages of the Seller towards a B2B Client is limited to the value of the paid order.

§ 8. Out-of-court dispute resolution

  1. The Consumer has the opportunity to use out-of-court procedures for handling complaints and pursuing claims. They may, among others, apply to a permanent amicable consumer court or seek assistance from a poviat consumer ombudsman.
  2. The EU online dispute resolution platform (ODR Platform) is available at http://ec.europa.eu/consumers/odr.

§ 9. Final provisions

  1. Agreements concluded through the Online Store are concluded in Polish (or translated for informational purposes).
  2. The Seller reserves the right to make changes to the Terms and Conditions for important reasons (e.g., changes in the law, changes in payment or delivery methods). Contracts concluded before the amendment to the Terms and Conditions are governed by the version in force on the date the order was placed.
  3. In matters not covered by these Terms and Conditions, universally applicable provisions of Polish law apply, in particular: the Civil Code and the Consumer Rights Act.
